End of American sovereignty: Biden administration negotiates “legally binding” deal

The Biden regime never fails to devise a way to circumvent the US Constitution and betray the American people. A bombshell report in The Epoch Times on Saturday revealed that the administration is about to cede US sovereignty to the World Health Organization (WHO) and give them full control over future pandemic policy.

Gateway Pundit has reported extensively on these discussions between the government and the WHO over the past year.

TGP’s Alicia Powe, for example, exclusively revealed that Biden’s Health and Human Service Department secretly submitted proposed amendments to “Strengthen WHO’s Preparedness and Response to Health Emergencies,” reforming the 2005 International Health Regulations to the WHO. The zero draft gives the World Health Organization the power to declare and manage a global pandemic emergency. Once a health emergency is declared, each signatory, including the United States, must submit to WHO’s authority. This includes their caving in on treatment, lockdowns and vaccine mandates, including government surveillance.

Even more chillingly, the Biden administration doesn’t think they need to submit the deal to Senate approval because they’re not calling it a government deal even though it has full force. Common sense tells us this is an unconstitutional strategy but the Obama administration skated into the original Iran deal using similar legal arguments.

Counting on the federal courts to save us may also prove foolish, even if they lean slightly to the right. The Epoch Times reminds us that there are a number of Supreme Court cases where previous administrations have prevailed in similar situations.

The first was Missouri v. State of Holland, in which the Supreme Court ruled that treaties preempted state laws. The second decision, United States v. Belmont, ruled that executive agreements without Senate consent could be legally binding by force of treaty.

We also have Supreme Court justices nominated by Republicans who are not reliably conservative. We cannot count on their willingness to break precedent and uphold the Constitution.

The Biden administration is preparing to sign up the United States to a “legally binding” agreement with the World Health Organization (WHO) that would give the Geneva-based UN subsidiary the power to set American policy during the pandemic.

Despite widespread criticism of WHO’s response to the Covid pandemic, US Health and Human Services (HHS) Secretary Javier Becerra joined WHO Director-General Tedros Adhanom Ghebreyesus in September 2022 to announce a “US-WHO Strategic Dialogue”. Together, they created a platform to “maximize the long-standing US government-WHO partnership and protect and promote the health of all people around the world, including the American people.”

The WHO pandemic agreement is part of a two-track effort, coinciding with an initiative by the World Health Assembly (WHA) to create new global pandemic regulations that will also override the laws of member states. The WHA is WHO’s rule-making body, made up of representatives from Member States.

“Both [initiatives] Terribly dangerous,” Francis Boyle, a professor of international law at the University of Illinois, told The Epoch Times. “Either one or both will establish a global medical police state under the control of WHO and especially WHO Director-General Tedros. If one or both of these go through, Tedros or his successor will be able to issue orders that will go down the pipe to your primary care physicians.”

A key question surrounding the deal is whether the Biden administration can bind America to treaties and agreements without the consent of the US Senate, which is required under the Constitution. The null draft recognizes that, under international law, treaties between countries must be ratified by national legislatures, thus respecting the right of consent of their citizens. However, the draft also contains a clause that the agreement will enter into force on a “provisional” basis, as soon as it is signed by WHO representatives, and therefore it will be legally binding on members without being ratified by the legislature.

There are several US Supreme Court decisions that could support the Biden administration. This includes State of Missouri v. Holland, where the Supreme Court ruled that treaties superseded state laws. Other decisions, such as United States v. Belmont, ruled that executive agreements without Senate consent could be legally binding with treaty force.

WHO, the US Department of Health and Human Services, and the World Bank were contacted about this article but did not respond.

Assuming the administration finalizes this deal, the next pandemic will completely evaporate our freedoms and kill countless Americans in the process. Any member of Congress who does not move to impeach Biden in this matter is abdicating their constitutional duty.
