Will Chief Justice Roberts Respond to Senator Wyden’s Attack on Judge Kasmaric?

In March 2020, Senator Charles Schumer stood outside the Supreme Court and attacked two new members:

“I want to tell you, Gorsuch. I want to tell you, Kavanaugh. You unleashed a whirlwind, and You will pay the price. You don’t know what hit you If you go ahead with this horrible decision.”

That same day, Chief Justice Roberts issued a strong response to Schumer’s comments:

This morning, Senator Schumer spoke at a rally in front of the Supreme Court while a case was being argued inside. Senator Schumer mentioned two members of the court by name and said he wanted to tell them that “you unleashed a hurricane, and you’re going to pay the price. If you go forward with these terrible decisions, you won’t know what hit you.” Justices know that criticism comes with the territory, but these kinds of threatening statements from the highest levels of government are not only inappropriate, they are dangerous. All members of the Court shall carry on their duties from any quarter, without fear or favour.

Yesterday, Senator Ron Wyden released a scathing attack on Kasmaric, a judge in the Northern District of Texas. Wyden echoed many of the barbs repeated over and over in Slate, Vox and elsewhere. Here are some of his comments:

Legal logic be damned, plaintiffs know that Judge Kakasmarik won’t let pesky obstacles like precedent stand in the way of their shared agenda.

Because Donald Trump and conservative activists put him on the Amarillo court bench. They know that she has spent her entire career fighting shoulder-to-shoulder with them for LGBTQ equality, abortion, and contraception.

He is there for what I would call “court washing”.

In courtwashing schemes, right-wing activists know it’s their role to give the appearance of judicial legitimacy to the results they’re getting as soon as their cases show up on their dockets.

In the few years that Judge Kasmaric has been on the federal district court, he has earned the title of the most lawless judge in the country. It is difficult to achieve such notoriety in such a short period of time, but his judgments justified it. . . .

The grim reality is that, from the moment this case came before Judge Kasmaric, it was a rigged game. It is illegal. The case is an affront to the Constitution and the rule of law in the United States.

So here’s if and when the judge issues his nationwide injunction to cut off casual access to mifepristone.

President Biden and the FDA must ignore it.

Wyden’s comments made Schumer seem calm. When will Chief Justice Roberts release a statement? Chief Justice Marshall can certainly be mentioned here.
